A man has been charged with aggravated assault by auto within 1,000 feet of a school after crashing into a 28-year-old pedestrian while driving under the influence. Victor Kwak, the intoxicated driver, lost control of his Lexus the night of August 22 and hit a curb, struck a tree, hit a wooden utility pole and then swerved back onto the sidewalk, hitting pedestrian Sandra Munoz-Molina.
Munoz-Molina was rushed to Hackensack University Medical Center and received treatment for a traumatic brain injury.
Kwak was observed as being intoxicated on the scene and provided police with a blood sample. The results have not yet been released, but Kwak has been charged with aggravated assault by auto within 1,000 feet of a school, which is a second-degree crime. He also has multiple motor vehicle summonses, including reckless driving and driving while intoxicated.
According to The Century Council, a nonprofit organization against drunk driving and underage drinking, New Jersey had a total of 193 alcohol-impaired driving fatalities in 2011, 30.8 percent of which involved alcohol-impaired drivers. In the entire U.S., almost 10,000 people died in drunk driving accidents in 2010, according to the National Highway Traffic Safety Administration. That is an average of one alcohol-impaired driving fatality every 51 minutes.
