The wife of a man killed in a Mount Olive truck accident filed a lawsuit against a trucking company on December 17. The fatal truck accident lawsuit against Mountain View Development and Contracting Co. Inc. claims that the company is responsible for the truck accident that killed the plaintiff’s husband on December 2.
According to the lawsuit, the company did not properly attach a 50-ton trailer that crashed into her husband’s vehicle, killing him upon impact. Officials reported that around 2 p.m. on December 2, the plaintiff’s husband was traveling on Route 280 West in a Honda when a trailer detached from the truck in front of him, colliding with his vehicle and killing him instantly. The victim was pronounced dead at the scene.
The lawsuit alleges that the driver of the truck “failed to inspect, assemble and/or operate the aforesaid truck and trailer in a proper, careful manner,” ultimately causing the accident and the death of the plaintiff’s husband. The lawsuit claims that Mountain View is “liable for the negligence of its driver.” At the time of this report, no charges in the accident have been filed. The collision is still under investigation by State Police.
Truck accidents involving mechanical defects are often caused by driver inattention during pre-trip inspections or by manufacturing errors and negligence. These commercial trucks and trailers are incredibly heavy, some weighing up to 80,000 pounds. When these huge trucks are involved in accidents with passenger vehicles, they can seriously injure or kill other drivers.
